3 Contracts You Need to Protect Your Business

Congracts!

You did it – you’ve launched your own business!

Now that you’re officially an entrepreneur, it’s time to make sure your legal foundation is solid. But let’s be real – you didn’t sign up for entrepreneurship to spend all day reading contracts. And trust me, it takes a lot of reading! You’ve got a thousand other priorities on your list, and legal paperwork probably isn’t the most exciting one. So let’s keep this quick and to the point!

Here are the three must-have contracts to keep your business safe and sound:

  1. Terms and Conditions & Privacy Policy
Got a website? Then these two are a must! And before you roll your eyes and say, “Polina, but does anyone actually read these?”… hear me out!

Your Terms and Conditions are basically the rulebook for how visitors can use your website and your content. Plus, if you’re selling stuff, it explains your sales terms, refunds, and returns policy. Not to mention, it makes sure no one’s swiping your intellectual property (like your awesome photos or blog posts).

As for your Privacy Policy, it’s required by law (yes, even for small businesses!) under the GDPR. It explains how you collect, store, and use personal data (yep, those cookies you’re using count). It’s super important to make sure your Privacy Policy reflects how your business actually collects and uses this info, so don’t just copy-paste one from the internet!

  1. Client Services Contract
Before you dive into that exciting new project, make sure you and your client are on the same page!

If you’re offering paid services, a Client Services Contract is a lifesaver. It spells out exactly what you’re doing for them, when you’ll deliver, payment terms, cancellation policies, and – most importantly – it protects you from any misunderstandings.

The biggest mistake I see? Contracts that are too one-sided – either totally favoring the business or the client. The goal is to find a balance and set the tone for a great partnership from day one. Pro tip: make this a key part of your onboarding process and watch how smoothly things go!

  1. Independent Contractor Agreement
Hiring your first freelancer or contractor? That’s a huge milestone! But before you start celebrating, make sure you’ve got a solid Independent Contractor Agreement in place.

In the Netherlands, the line between contractor and employee can get blurry, and the tax authorities take it seriously. Make sure your agreement clarifies that your contractor:

  • Uses their own tools and equipment.
  • Can work for other clients (they’re not exclusive to you).
  • Is responsible for their own taxes (phew, less work for you).
  • Has control over how they do the job.

Not having this clear? It could lead to hefty financial consequences down the road, so better safe than sorry!

With these three contracts in place, you’re all set to grow your business with confidence, knowing you’ve got the legal stuff locked down.
